TERMS AND CONDITIONS

These terms and conditions are the basis of the legal relationship between an Associate and Polish Australian Business Forum (“PABF”). You agree to be bound by these terms and conditions when you proceed with the registration process.

Associateship Criteria

Associateship of PABF is open to any company, trust, publicly listed company, ABN holder, firm or individual actively engaged in business or a profession or any director or executive officer of a public institution (Associate) connected with commerce or industry and wanting to work with Polish businesses, support Polish businesses in Australia and/or in Poland.  Such Associate shall be eligible for Associateship of PABF.  PABF executive has the discretion to limit the number of Associates in PABF from time to time.  Individuals who do not operate a business or who are not employed by a business or company are not eligible for Associateship.

Associateship Fees

Associateship Fees are invoiced upon joining and subsequently on the annual anniversary of the Associate’s membership renewal. Associateship gives you access to a range of Associate only benefits. 

The Fees below are current as at 1 January 2024 and PABF has the discretion to change the membership from time to time.  All fees are inclusive of GST.

The Associateship fees have been designed to deliver a flexible set of options that will suit the size and type of various Associates. For any queries about which Associateship is most suitable, please email engagement@pabf.com.au.

Annual Payment

  • The Annual Associateship Fees will be payable in full upfront upon applying for Associateship (or seeking renewal or reinstatement of Associateship for subsequent Associateship years (as the case may be).

  • If Associateship is resigned during an Associateship year, the Annual Associateship Fees for that Associateship year will not be refunded.

Associateship Termination 

An Associate may resign Associateship at any time by written notice of resignation to engagement@pabf.com.au.

PABF President, Vice-president, Treasurer or the Secretary has the right to terminate Associateship if: –

  • There are outstanding fees, including but not limited to the subscription fee, remain unpaid for a period of 7 days after the date that payment is due.

  • The Associate may have behaved in an inappropriate manner towards other Associates, towards PABF or Associates of the general public; are made aware of poor conduct, harassment, bullying or intimidation by the Associate towards their clients, PABF, or other Associates of the general public.

  • The Associate brings PABF or its reputation and good standing into disrepute through their actions.

  • The Associate breaches these terms and conditions.

  • Or any other reasons that the PABF President, Vice-president, Treasurer or the Secretary decide that the Associate is not acting in the best interest of PABF or towards these Associates and/or Executive.

Where PABF exercises its right to cancel the Associateship under these circumstances, no refund of any Associateship fee already paid or registration fees for upcoming events will be refunded.

Associateship by Groups of Companies

Where a company that is a part of a group of companies applies for Associateship, this does not entitle the parent company or any other subsidiary of the parent company to become an Associate. 

Each company in the group shall be required to apply separately for Associateship or the parent company shall take out a collective Associateship that embraces all parts of the group. Only decision makers of the company will be permitted to attend PABF events and the number of decision makers nominated by the company will be used to determine the Associateship category and annual Associateship fee payable which may differ to the fees listed above.

Severance

Each provision contained in these terms and conditions shall be severable from any other provisions, and if any part of any provision shall be found to be invalid, illegal or void for any reason, this will not affect any other part of such provision or any other provision contained in these terms and conditions, which shall continue to have full force and effect.

Entire Agreement

These terms and conditions supersede all prior agreements, negotiations, representations and proposals, whether written or oral, concerning the subject matter of the terms and conditions of your Associateship of PABF.

Other Prevailing Conditions

You also agree to be bound by any other terms and conditions of PABF as are in force or amended from time to time.

Associates are required to familiarise themselves with these terms and conditions.

Governing Law

These terms and conditions shall be construed in accordance with the laws of Australia and the parties hereby submit to the exclusive jurisdiction of the Australian Courts.

Third Parties

No rights are conferred on any person who is not a party to these terms and conditions.

Assignment

You shall not assign any of your rights or obligations under these terms and conditions without PABF’s President, Vice-President, Treasurer or Secretary’s prior written consent. We shall have the right to assign or otherwise delegate all or any of our rights or obligations under these terms and conditions upon notification to you.

Disclaimer

PABF gives you no warranty or assurance about any recommendations or referrals we make in respect of third parties and the services they supply. You should always satisfy yourself as to the status of any such third parties and the suitability of the services they supply. All implied warranties and conditions are excluded to the maximum extent permitted by law.

PABF only provides you with such recommendations and referrals on the basis that all representations, warranties, conditions and other terms are excluded to the maximum extent permitted by law (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill which, but for this legal notice, might have effect in relation to any referral or recommendation).

Events

All events must be booked and, where a fee is payable, it must be paid in advance of the event. Failure to comply could result in your place at the event being withdrawn.

Failing to attend an event does not entitle you to a refund. Any refunds are entirely at the discretion of PABF executive.

Errors and Omissions

Every care is taken to ensure that all information in PABF’s publications, including the website and any communication to PABF Associates, is correct. However, there may still be errors and we apologise for any inconvenience that this may cause. If you find an error or omission, please let us know, and we will verify it and correct it as soon as possible.

Intellectual Property

PABF owns the intellectual property, including copyright, in all content of its publications.

Reproduction of any PABF publication is not permitted without prior written authorisation from PABF. If PABF grants permission, Associates must give appropriate attribution to the author and date of first publication.

Website Privacy Notice

Visitors to this site should expect that any information collected will be treated within the terms of the NSW Government’s privacy responsibilities and obligations. 

What information do we collect?

When visitors look at the pages of our website, our computers record information that identifies the:

  • IP (Internet Protocol) address of the machine which accessed it

  • top-level domain name (for example .com, .gov, .au, .uk, etc.)

  • address of the server

  • date and time of the visit to the site

  • pages accessed and documents downloaded

  • previous site

  • type of browser and operating system you have used.

How do we use the information collected?

  • The information collected during each visit to the site and is gathered with similar logged information and published in reports to identify patterns of usage. This will assist us in improving this site and the services offered.

  • PABF will not disclose or publish information that identifies individual computers, or potentially identifies sub-groupings of addresses, without consent or otherwise in accordance with the NSW legislation.

Photographs and Shared Media – permission and authorisation

  • By completing the associateship application, you grant the PABF permission to use the information uploaded in the Associateship profile, including artwork, logo’s photos for marketing purposes for the PABF displayed on the website or social media channels and promotional marketing material.

  • By completing the Associateship application, you agree to authorise and release any photos taken of you or your business at PABF events can be used for marketing purposes for the PABF displayed on the website or social media channels and promotional marketing material.

Associates Must Agree to the Following

By applying for Associate Associateship of the PABF, you acknowledge that you have read and agreed to the terms and conditions of the Associateship.

Every applicant shall apply using an appropriate form supplied by the PABF.

You do not have an automatic entitlement to the Associate Associateship and PABF may, at its sole discretion, elect to refuse your application to become an Associate. PABF is not obliged to give reasons for its decision to reject your application at any time.

Prices, benefits and services are subject to change at any time as approved by the President, Vice-President, Treasurer or Secretary (PABF Executive) in accordance with our Constitution and internal regulations.

If any information we hold about you is incorrect, please notify us and we will update our records.

Associateship status is non-transferable.

Annual Renewal

Associate associateship is provided on an annual renewal basis for all Associates. The annual fee for the Associate Associateship is set out above and can be subject to change at any time as approved by the PABF Executive in accordance with our Constitution and internal regulations. Any such change will be communicated to all Associates at least four weeks prior to the date it takes effect.

Associates will receive an associateship renewal notice approximately two weeks prior to their renewal date and can elect to renew, apply for a different level of associateship and continue with their associateship or cancel it.

PABF has the right to withdraw any or all benefits and services including any associateship discounts if annual associateship fee payment is not received within 7 days of the annual renewal date. PABF reserves the right to cancel any Associate associateship where the annual fee remains unpaid 7 days after the due day.

The annual associateship fee shall be paid through bank transfer based on provided invoice or by card through www.pabf.com.au.

Annual renewal fees are non-refundable and non-transferable once paid.

Cessation of the Individual Associate Associateship

The Associate Associateship is cancelled if the annual fee remains unpaid 7 days after the due day. Subsequently, the Associate’s name is removed by PABF from the Register of Associates and all social media including the PABF website.

An Associate may at any time by giving notice in writing to the Secretary resign from his/her Individual Associateship of the PABF but shall continue to be liable for an annual subscription and all arrears due and unpaid at the date of his/her resignation and for all other monies due by him/her to PABF.
